The case involves a teenage male who was tackled by two city police officers on March 30, 2020 and suffered a severe hip injury as a result of the force exerted by the officers. Attorney Richard Cummins filed the lawsuit on November 11, 2020 on behalf of the teen by his father, Donald Cubitt, in the United States District Court for the Western District of Michigan. Civil rights cases in Federal Court are generally filed under Section 1986 of the U.S. Civil Rights Act. Actions against the police for excessive force under Section 1983 may be eligible for several types of damages, against both individual officers, as well as the police force itself and the municipality where the force is located. These damages may include:

- Mental Anguish: Damages awarded for the emotional distress and mental suffering caused by the incident.
- Punitive Damages: These damages aim to punish the defendant, the law enforcement agency or officer, for their willful or reckless conduct, and to deter similar behavior in the future. They are awarded on top of compensatory damages and are contingent upon proving the officer’s conduct was intentional or egregiously reckless.
- Attorney Fees and Costs: If the plaintiff prevails in the case, they may be entitled to recover reasonable attorney fees and litigation costs incurred during the case. This is to ensure that individuals who have had their civil rights violated have access to legal recourse without being financially burdened by the litigation.
