What is the DePuy Synthes Radial Head Prosthesis System?
The DePuy Synthes Radial Head Prosthesis System is an implanted medical device that replaces elbow joints. In 2016, DePuy, the company that created the device, issued a recall of over 50,000 units based on claims that a stem that was attached to the device was prone to loosening. When the stem loosened, patients became at risk of suffering serious side effects, including broken bones and fractures, loss of bone tissue, and excruciating pain.
The DePuy Synthes Radial Head Prosthesis System consists of two parts. One part is a synthetic head—the knobby end to one of your forearm bones—which replaces the natural radial head. The second part is a stem that is implanted into the radius—the bone to which the synthetic head is attached. The device is designed to restore joint function where a patient has suffered an elbow fracture that can’t be repaired, has worn down their elbow joint over time, or suffers from certain degenerative diseases, such as arthritis.
Is the DePuy Synthes Radial Head Prosthesis System Defective?
In 2016, patients began having issues with the device, reporting complications from a loosened stem. Initially, DePuy did not know why the device malfunctioned in some patients. Notwithstanding the evidence of a defect, DePuy continued to sell the device for use in revision surgeries that only required replacement of the head component.
Subsequently, in 2016, Johnson & Johnson (the company that owns DePuy) issued its own recall of the device. The stated reason for the recall was that the component implanting the device into the radius bone could detach, causing the destruction of bone tissue, fractures, joint problems and excruciating pain. The FDA reported 40 instances of the loosening failure and subsequently labeled the company’s action a Class 2 Device Recall. According to the FDA, Class 2 device recalls are those that are capable of resulting in a health problem for which there is a “slight chance that it will cause serious health problems or death.” Since then, there are have a number of DePuy Synthes Radial Head Prosthesis System lawsuits filed by patients who suffered long-term injuries resulting from this device.
What Are a Consumer’s Remedies After Suffering an Injury Due to a Dangerous Medical Device?
If you suffered a serious injury due to a dangerous or defective medical device, a product liability claim may provide you with meaningful compensation intended to cover all the expenses you incurred as a result of your injury. If successful, you may be entitled to the following damages:
- Medical bills;
- Future medical expenses related to your injuries;
- Lost wages;
- Decrease in earning capacity due to ongoing limitations;
- Pain and suffering; and
- Other related expenses or losses.
In many cases, these product liability cases proceed on a strict liability theory, meaning you do not need to prove that the manufacturer was negligent; only that the device was dangerous or defective. Still, successfully bringing a medical device lawsuit against a multi-billion-dollar corporation will raise certain challenges. Thus, it is best to work with an experienced product liability attorney to increase your chances of success and maximize your recovery amount.
