Surrogacy Attorneys

Surrogacy laws differ in each state and can often be very difficult to navigate. As of April 2025, the state of Michigan has enacted a The Assisted Reproduction and Surrogacy Parentage Act to make all forms of surrogacy fully legal. This law is designed to protect parents and surrogates and helps to provide the right to parenthood. Additionally, this law provides that surrogates can be compensated for their dedication, emotional, and physical commitments. Prior to the enactment of this important law, Michigan was the only state that provided for criminal and civil bans on surrogacy, resulting in any agreements being unenforceable.

The new laws in Michigan make surrogacy contracts fully legally binding and enforceable. It also provides protections and inclusive support for LGBTQ+ members of our communities who wish to become parents via surrogacy. In order to prepare a surrogacy contract that complies with the requirements of the new law, it is imperative for you to contact an experienced surrogacy attorney at Neumann Law Group.

Our attorneys will represent prospective parents and potential surrogates in preparing these contracts. There are many criteria involved in the preparation of legal agreements that must be met. For example, a contract for surrogacy must meet the following criteria:

  • The contract must be in writing;
  • Each party (prospective parents and surrogate) must have their own separate legal counsel;
  • The contract must clearly outline the rights, responsibilities, and expectations of each party; and
  • In order to enter in a surrogacy contract, the prospective surrogate must be at least 21 years old, must have had at least one child, must complete medical and mental health evaluations, and must provide consent;
  • The prospective parents must also undergo mental health consultations.

We will evaluate your proposed contract, assist in preparing it, and work with the other party’s attorneys to negotiate terms that are mutually agreeable to both prospective parents and their surrogates. Terms such as financial compensation for surrogates, joint medical decisions, and legality of the legal parentage should be included in your contracts. Other considerations can include termination clauses and dispute resolution.
