It is important to note that under Massachusetts law, there is no cap on economic damages. Non-economic damages, however, are capped at $500,000 in medical malpractice cases, unless an injured person can demonstrate that he or she sustained any of the following: a substantial or permanent loss or impairment of a bodily function; substantial disfigurement; or other special circumstances in the case that show applying the cap would deprive the injured person of justice.

Please bear in mind that there’s a specific timeframe, referred to as the statute of limitations, within which personal injury and wrongful death claims must be lodged. In accordance with Massachusetts law, a personal injury claim needs to be submitted within three years of the incident. Likewise, for a wrongful death lawsuit, the filing period is limited to three years from the date of the individual’s passing. Should the case not be initiated within this stipulated timeframe, it typically will not be permitted to be heard.
