Exactech Knee, Hip, and Ankle Joint Implants
Dedicated Traverse City Injury Lawyers Holding Manufacturers of Defective Medical Devices Accountable on Behalf of Injured Consumers
Neumann Law Group is accepting cases for injuries from defective Exactech joint replacement implants across the country. Exactech has now introduced a recall of thousands of its knee, hip, and ankle implants manufactured after 2004. Many of those injured have had or will need revision surgery. Exactech learned of the defects in their products around 2007. They made the decision to keep this information from patients and their doctors until late 2021.
About Exactech, Inc.
Exactech, Inc. of Gainesville, Florida, has been offering joint replacement options since the early 1990s. It quickly rose to be one of the most successful orthopedic device manufacturers in the world. Their goal was to work hand in hand with surgeons to learn about the problems that came from implant surgery and to help improve results moving forward. Exactech generates approximately $263 million in annual revenue.
Why Were Exactech Joint Implants Recalled?
Exactech recalled these implants years after realizing they were being shipped in defective packaging. According to reports, too much oxygen was being let into the product’s packaging, causing polyethylene—or plastic—inserts in the implants to deteriorate. The defective vacuum-sealed bags were not created according to existing safety standards and have since been determined to be the cause of injury to patients, which often requires painful and invasive revision surgery.

Symptoms of a Defective Exactech Joint Implant

- New or worsening swelling of the ankle or knee,
- Pain while walking,
- An inability to bear weight,
- Grinding or other noise in the knee, hip, or ankle,
- Instability while walking,

What Should I Do if Exactech Tries to Settle My Case?
Exactech is making attempts to direct those injured by their negligence into small settlements through a third party, Broadspire. Their recall website directs patients to contact Broadspire to make a claim and request reimbursement for any out-of-pocket expenses. According to the current Exactech recall website, filing a claim through Broadspire may make you eligible to receive limited compensation for “copays, deductibles, and reasonable travel expenses associated with seeing the surgeon” who installed the implant. Exactech will also cover some of the unreimbursed costs associated with a revision surgery; however, Exactech will not compensate you for any of your pain and suffering or any future medical expenses. They won’t even replace the failed implant.
Most importantly, if you decide to make a claim with Broadspire, you may be waiving your right to file a lawsuit against Exactech, which means you could be leaving a significant amount of money on the table.
