WIth this, an injured plaintiff must demonstrate that they are at most 49% responsible for an accident in order to recover non-economic damages. In cases with large amounts of damages or lopsided amounts of damages between two partially culpable parties, the difference between a finding of 49% fault and 50-50 fault can be hugely significant. It is important to note that a responding law enforcment officer’s judgment as to fault is not necessarily the final allocatin of fault that a court will use. Because of this, it is important for plaintiffs to have an effective strategy to demonstrate that they were less then 50% responsible for an accident.
